The Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule is a regulation that requires Bright Track Kids, LLC to ensure your medical information is kept private and that we notify you of our privacy practices with respect to your medical information. 1 ) Medical Information: Your records (“Medical Information”) may consist of your child’s evaluations, diagnosis, daily notes, progress notes, letters of necessity, insurance information, physician prescriptions, and correspondences to your other providers (e.g. physicians, therapists, service coordinators, etc.). The information inside your child’s medical record will be used for treatment, to obtain payment, and to operate our healthcare business.

2 ) Collection, Storage, Disclosure, and Disposal of Medical Information:

Our policy is to keep your child’s records safe. Your child’s records are stored as an electronic record on a computer via password-controlled access, via secured internet and password-controlled access. We may receive your child’s Medical Information via email, mail and/or fax, which is limited to our use only. Some of your Medical Information may be transmitted via electronic methods for the purposes of billing and obtaining payments for services rendered. All electronic transmissions will be submitted using encrypted coding per HIPAA code 160.103.

Your Medical Information will only be shared with those whom you so indicate on your consent for release of information form (e.g. your physician, teachers). You will be notified of any requests to share any information with any person not listed on the form. In that situation, your written permission will be obtained first.

Your Medical Information might be shared with law enforcement or the courts as required by law.

Your Medical Information will be kept and stored for a minimum of six years. Your records will then be disposed of appropriately, permanently deleted or shredded.

3 ) Your Health Information Rights:

You have the right to inspect and receive a copy of your child’s personal health information. The request must be made in writing to us.

Your child’s personal health and medical information will be requested and shared only with those parties whom you have provided written consent.

A written record will be kept of all disclosures of your child’s personal health information.

You have the right to request an amendment to your child’s heath record if it contains an error.

You have the right to revoke your written consent/authorization to use or disclose your child’s health information.

You have the right to file a complaint if you believe we have violated your privacy rights. You may file a complaint to us or with the Secretary of the Department of Health and Human Services. There is no risk involved if you file a complaint.
